Terms & Conditions

These Terms govern your access to and use of Gamira, including our website, mobile application, AI companion, Family Dashboard, care coordination features, reports, emergency features, connected services, and related products and services.

Acceptance of Terms

By creating an account, accessing, subscribing to, or using Gamira, you agree to these Terms & Conditions ("Terms").

If you do not agree with these Terms, you must not use Gamira.

These Terms apply to all users, including Parents/Care Recipients, Family Members, Family Administrators, Caregivers, Doctors/Healthcare Professionals, and other authorized users.

About Gamira

Gamira is an AI-powered companion and care-coordination platform designed to help older adults maintain greater independence while enabling their families to stay connected, informed, and involved in their care.

Depending on the applicable plan, device, permissions, location, integrations, and technical availability, Gamira may provide:

  • AI voice companionship
  • Conversational AI
  • Medication reminders
  • Health and wellness tracking
  • Family monitoring and care coordination
  • Reminders and schedules
  • Emergency and SOS features
  • Location sharing
  • Fall-related alerts
  • Doctor appointment coordination
  • Health and wellness reports
  • Family dashboards
  • Connected-device functionality
  • Other digital care-support services

Gamira is a technology platform and is not itself a hospital, clinic, doctor, emergency service, ambulance provider, insurance provider, or healthcare professional.

Features may change as Gamira develops.

2.1 Who provides Gamira

Gamira is operated by Lokesh Bhatt, an individual (the "Seller"). The operator's postal address is available on request at bhattlokesh2004@gmail.com. Gamira is not currently a company or other separately registered legal entity. When you buy a plan, your contract is with the Seller.

In these Terms, "Gamira", "we" and "us" mean the Seller as the operator of the Gamira service, except where the context shows that they mean the service itself.

User Roles

3.1 Parent / Care Recipient

The person receiving care, companionship, reminders, monitoring, or other Gamira services.

3.2 Family Member / Family Administrator

A family member or authorized person who manages the Family Dashboard and care environment.

Depending on account configuration, the Family Administrator may be able to:

  • Manage connected family members
  • Configure reminders and schedules
  • Review available health and wellness information
  • Review alerts and care information
  • Manage permissions
  • Generate or access reports
  • Manage account-level data controls
  • Request deletion of data where applicable

3.3 Doctor / Healthcare Professional

Gamira may allow users to generate and share reports with healthcare professionals.

Doctors do not automatically receive direct access to a user's Gamira account, Family Dashboard, or underlying personal data merely because the user uses Gamira.

3.4 Other Authorized Users

Gamira may permit caregivers or other authorized persons to participate in a care environment where appropriate permissions and authorization exist.

Users are responsible for ensuring they have appropriate authority before granting another person access.

Eligibility and Authority

You must be legally capable of entering into these Terms to use Gamira.

If you create, manage, or use a Gamira account on behalf of another person, you represent that you have the appropriate authority to do so.

Gamira may request additional verification, consent, age verification, or authorization where necessary.

You must not create or manage an account on behalf of another person without appropriate authorization.

Accounts and Security

Users must:

  • Provide accurate information
  • Keep account information reasonably current
  • Protect login credentials
  • Prevent unauthorized access
  • Notify Gamira promptly of suspected unauthorized access
  • Use the account only for lawful purposes

Users are responsible for activity occurring through their account to the extent permitted by applicable law.

Family Dashboard and Access Controls

Gamira may provide a Family Dashboard through which an authorized family member may manage and review information relating to a Parent or other care recipient.

Access to information is based on account structure, permissions, consent settings, applicable law, and available product functionality.

A Family Administrator may have broader administrative and data-management permissions than a Parent account.

Gamira may restrict certain actions, including deletion or modification of certain records, from the parent view where the account architecture requires administrative control to be maintained by an authorized Family Administrator.

Nothing in these Terms removes or restricts mandatory legal privacy rights available to an individual.

Personal, Health, Voice and Care Data

Gamira may process information including:

  • Name and contact information
  • Account information
  • Voice recordings
  • Conversations and transcripts
  • Preferences and memories
  • Reminders and schedules
  • Medication-related information
  • Health and wellness information
  • Activity information
  • Sleep information
  • Vital-sign information
  • Emergency information
  • Location information
  • Reports
  • Documents
  • Images
  • Communications
  • Other information necessary to provide the Services

The collection, use, storage, sharing, retention, security, and deletion of personal information are further described in Gamira's Privacy Policy.

Where applicable, Gamira will process personal information in accordance with applicable privacy and data-protection laws.

Voice Recordings, AI Processing and Service Improvement

Gamira may process voice recordings, conversations, transcripts, interactions, and other information generated through use of the Services to operate and improve Gamira.

Where permitted by applicable law and subject to the disclosures and controls described in the Privacy Policy, Gamira may use processed data for:

  • Operating AI features
  • Improving AI responses
  • Improving product performance
  • Developing and evaluating models
  • Safety and quality evaluation
  • Personalization
  • Research and development
  • Security and fraud prevention
  • Improving Gamira's products and services

Gamira may use automated processing and AI technologies to analyze information.

The specific categories of data used for AI training, model improvement, analytics, personalization, or other purposes are governed by the Privacy Policy, user settings, consent requirements, and applicable law. Not all user data is automatically used for AI training.

AI Features

Gamira uses artificial intelligence and automated technologies.

AI-generated responses may be:

  • Inaccurate
  • Incomplete
  • Outdated
  • Misunderstood
  • Inappropriate
  • Unsuitable for a particular situation

Gamira does not guarantee that AI-generated information will always be correct.

Gamira is an AI companion and technology service, not a human professional.

AI responses must not be treated as a substitute for:

  • Medical advice
  • Diagnosis
  • Treatment
  • Emergency assistance
  • Legal advice
  • Financial advice
  • Other professional advice

Users should exercise reasonable judgment and seek qualified professional assistance where appropriate.

Health and Wellness Features

Gamira may allow users to record, organize, monitor, or receive information relating to:

  • Medication
  • Heart rate
  • Blood pressure
  • Oxygen levels
  • Temperature
  • Sleep
  • Steps
  • Activity
  • Wellness
  • Other health-related information

Gamira is intended to support awareness, organization, communication, and care coordination.

Unless expressly provided through an authorized third-party healthcare service, Gamira does not:

  • Diagnose diseases
  • Prescribe medication
  • Determine medical treatment
  • Replace a healthcare professional
  • Guarantee a medical outcome

Users remain responsible for consulting an appropriately qualified healthcare professional.

Medication Reminders

Gamira may provide medication reminders, schedules, medication-related notifications, and related features.

Users are responsible for entering and maintaining accurate medication information, schedules, dosages, and instructions.

Gamira does not guarantee that:

  • A reminder will always be generated
  • A reminder will always be delivered
  • A user will see or hear a reminder
  • A user will take medication
  • Medication information will always be accurate
  • A medication-related outcome will be achieved

Gamira does not prescribe or recommend medication merely by providing reminder functionality.

Emergency and SOS Features

Gamira may provide:

  • SOS buttons
  • Emergency notifications
  • Family alerts
  • Location sharing
  • Fall-related alerts
  • Emergency communication
  • Other safety-related features

Emergency functionality may depend on:

  • Device availability
  • Battery level
  • Internet connectivity
  • Mobile network coverage
  • Device permissions
  • Location permissions
  • Configuration
  • Third-party services
  • Connected devices
  • Other technical circumstances

Gamira does not guarantee that an emergency will always be detected or that an alert will always be:

  • Generated
  • Transmitted
  • Delivered
  • Received
  • Noticed
  • Answered
  • Acted upon

Gamira must not be relied upon as the sole method of obtaining emergency assistance.

In an immediate or life-threatening emergency, users should directly contact the appropriate local emergency service.

Family Alerts and Notifications

Gamira may send notifications to authorized family members or other permitted users based on configured rules, events, reminders, monitoring features, or other system conditions.

Notifications may be delayed, missed, incorrectly triggered, or unavailable due to technical or external circumstances.

Users are responsible for ensuring that:

  • Notification settings are correctly configured
  • Contact information is accurate
  • Device permissions are enabled
  • Communication methods are functional

Doctor Reports and Healthcare Sharing

Gamira may allow users or authorized family members to generate:

  • Health reports
  • Wellness reports
  • Medication reports
  • Activity reports
  • Care-related reports

Reports may be available in formats such as PDF, CSV, or other supported formats.

Reports may be shared through supported methods such as email, WhatsApp, download, or other available communication methods.

Gamira does not automatically provide doctors with unrestricted access to a user's Gamira account or Family Dashboard.

A healthcare professional receives information only through an authorized sharing mechanism or when a user or authorized person independently provides the information.

Users are responsible for reviewing information before sharing it.

Gamira does not guarantee that a healthcare professional will receive, review, interpret, or act upon a report.

User Content

Users may provide:

  • Messages
  • Voice recordings
  • Preferences
  • Images
  • Documents
  • Health information
  • Reminders
  • Notes
  • Other content

Users retain their rights in their User Content to the extent provided by applicable law.

By using Gamira, users grant Gamira the limited rights necessary to host, process, transmit, display, analyze, secure, maintain, and otherwise use User Content to provide the Services and for additional purposes described in the Privacy Policy.

Users are responsible for ensuring they have the necessary rights and permissions to provide information about another person.

Data Access, Correction and Deletion

Gamira provides data-management functionality based on account structure and applicable law.

The Family Administrator may have administrative controls for managing and deleting certain account data.

The parent view may not provide direct deletion controls for certain data categories where administrative control is intentionally assigned to the authorized Family Administrator.

However, nothing in these Terms prevents an individual from exercising mandatory rights of:

  • Access
  • Correction
  • Deletion
  • Restriction
  • Objection
  • Portability
  • Other applicable privacy rights

Gamira may retain certain information where required or permitted by law, including for:

  • Security
  • Fraud prevention
  • Dispute resolution
  • Legal compliance
  • Backups
  • Legitimate operational purposes

Intellectual Property

Gamira and its underlying software, AI systems, technology, design, branding, trademarks, interfaces, graphics, text, databases, systems, and other materials are owned by or licensed to the Seller and protected by applicable intellectual-property laws.

Users may not:

  • Copy
  • Reproduce
  • Distribute
  • Modify
  • Reverse engineer
  • Decompile
  • Extract source code
  • Sell
  • Lease
  • Sublicense
  • Commercially exploit

Gamira or its underlying technology unless expressly permitted.

Third-Party Services and Integrations

Gamira may rely on or integrate with:

  • AI providers
  • Cloud infrastructure
  • Payment providers
  • Communication providers
  • Healthcare services
  • Mobile platforms
  • Connected devices
  • Mapping/location services
  • Other technology providers

Third-party services may have separate terms, privacy policies, limitations, and availability requirements.

Gamira is not responsible for the independent operation of third-party services outside Gamira's reasonable control.

Subscriptions and Payments

Paid plans are not on sale yet. Until they are, no payment can be made for Gamira and nothing is charged. This section and section 21 describe how paid plans will work, and apply once they are on sale. From then, certain Gamira features require a paid plan.

20.1 Plans

The Starter plan covers one Parent/Care Recipient. The Family plan covers two Parents/Care Recipients. The features, limits, period and price of each plan are shown on the Pricing page and at checkout before you pay.

20.2 Free trial

A 14-day free trial of a paid plan may be available. The trial is free: nothing is charged for it, and it never turns into a paid plan automatically. When the trial ends, paid features stop unless you choose to buy a plan. The safety features described in section 20.6 continue, and your data is not deleted.

20.3 Buying a plan

Paid plans are sold only on the Gamira website. Payments are processed by Razorpay, a third-party payment provider; by paying, you authorise Razorpay to process that payment. Nothing is sold inside the Gamira Android app — the app only shows the status of a plan bought on the website.

20.4 No automatic renewal

Each payment buys one period of access — one month or one year, as shown at checkout. Plans do not renew automatically, and you will not be charged again unless you choose to make a new payment. To continue after a period ends, you renew manually by paying for a new period on the Gamira website.

20.5 Grace period

If a paid period ends and you have not renewed, your plan continues for a grace period of 3 days. If you have not renewed by the end of the grace period, your plan lapses.

20.6 When a plan lapses or you move to a smaller plan

The following safety features continue on a lapsed plan: SOS, family alerts, medicine reminders and wellbeing checks. Other paid features stop until you renew. Sections 11, 12 and 13 continue to apply to these features.

Letting a plan lapse, or moving to a smaller plan, never deletes your data. If your account has more people in it than your plan covers, they stay in the account, but you may not be able to add more until you move to a plan that covers them.

20.7 Taxes

The Seller is not registered for Goods and Services Tax (GST) and does not charge GST.

21

Refunds and Cancellations

21.1 Your first paid plan

If you ask within 7 days of paying for your first paid plan, you will receive a full refund of that payment.

21.2 Renewals

Payments for later periods (renewals) are normally non-refundable, except where a refund is required by a mandatory right under applicable law or by the rules of the payment platform used.

21.3 Free trial

Nothing is charged for the free trial, so there is nothing to refund.

21.4 How to ask for a refund

Email support@gamira.online from the email address on your account, with the payment reference if you have it. Approved refunds are paid back to the original payment method through Razorpay. When a payment is refunded in full, the paid period it bought ends; the safety features in section 20.6 continue.

21.5 Cancelling

Because plans never renew automatically, there is no recurring payment to cancel. You may stop using paid features at any time; stopping does not by itself entitle you to a refund except as set out in sections 21.1 and 21.2.

Mandatory consumer rights are not excluded.

Service Availability

Gamira aims to provide reliable Services but does not guarantee uninterrupted or error-free operation.

The Services may become unavailable because of:

  • Maintenance
  • Upgrades
  • Technical failures
  • Network failures
  • Security incidents
  • Device limitations
  • Third-party outages
  • Infrastructure failures
  • Circumstances beyond Gamira's reasonable control

Gamira may modify, suspend, replace, or discontinue features as the product develops.

Prohibited Use

Users must not use Gamira to:

  • Violate applicable law
  • Harass, threaten, abuse, exploit, or harm another person
  • Impersonate another person
  • Obtain unauthorized access to accounts or systems
  • Interfere with Gamira's security or operation
  • Reverse engineer or extract proprietary technology
  • Scrape or overload the Services
  • Upload malicious code or harmful files
  • Commit fraud or deception
  • Unlawfully access or share another person's information
  • Misuse emergency functionality
  • Intentionally provide materially false information for harmful purposes
  • Use Gamira as a replacement for emergency or professional medical services

Suspension and Termination

Users may stop using Gamira at any time.

Where available, users may request account deletion through the applicable account functionality or support process.

Gamira may suspend or terminate access where reasonably necessary, including where:

  • Terms are violated
  • Misuse occurs
  • Security or safety risks arise
  • Unlawful activity is suspected
  • Unauthorized access occurs
  • Continued provision of Services is no longer reasonably possible

Not renewing a plan is not a reason for suspension or termination: the plan simply lapses as described in section 20.6.

Where appropriate and legally required, Gamira may provide notice before suspension or termination.

Certain provisions survive termination, including:

  • Intellectual property
  • Disclaimers
  • Limitation of liability
  • Indemnification
  • Other provisions that by their nature should survive

Disclaimers

To the maximum extent permitted by applicable law, Gamira is provided on an "as is" and "as available" basis.

Gamira does not guarantee that:

  • AI responses will always be accurate
  • Health information will always be accurate
  • Reminders will always be delivered
  • Notifications will always be received
  • Emergency alerts will always work
  • Fall-related events will always be detected
  • Monitoring will always be accurate
  • Reports will always be complete
  • Third-party services will always operate
  • Services will always be available
  • Services will produce a particular medical, health, safety, emotional, or personal outcome

Nothing in these Terms excludes liability or rights that cannot legally be excluded or limited.

Limitation of Liability

To the maximum extent permitted by applicable law, the Seller and the Seller's contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising from or related to use of the Services.

This may include, where legally permitted:

  • Loss of data
  • Loss of profits
  • Loss of opportunity
  • Business interruption
  • Reliance on AI-generated information
  • Failure of reminders
  • Failure or delay of notifications
  • Emergency-alert failures
  • Third-party service failures
  • Other indirect losses

Nothing in these Terms limits liability that cannot legally be limited or excluded.

Indemnification

To the extent permitted by applicable law, users agree to defend, indemnify, and hold harmless the Seller and the Seller's contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

  • Violation of these Terms
  • Misuse of Services
  • User Content
  • Violation of another person's rights
  • Unauthorized access to another person's information
  • Unlawful or unauthorized use of Services

Changes to These Terms

Gamira may update these Terms to reflect:

  • Changes to Services
  • Technology developments
  • Security requirements
  • Business practices
  • Legal or regulatory requirements
  • Other relevant circumstances

For material changes, Gamira will take reasonable steps to provide appropriate notice where required.

Updated Terms will become effective on the date stated in the updated Terms.

Where applicable law requires affirmative acceptance of material changes, Gamira will obtain such acceptance.

Governing Law and Dispute Resolution

Gamira may operate across multiple jurisdictions, including India, the European Union, and the United States.

These Terms will be interpreted and applied subject to applicable law.

Nothing in these Terms is intended to deprive users of mandatory rights or protections provided by laws that legally apply to them.

Gamira may publish jurisdiction-specific terms where required.

General Terms

These Terms, together with the Privacy Policy and other policies expressly incorporated into them, constitute the agreement between users and Gamira regarding the Services.

If any provision is invalid or unenforceable, the remaining provisions continue to the extent permitted by law.

Failure by Gamira to enforce a provision does not constitute a waiver.

Nothing in these Terms creates:

  • Partnership
  • Employment relationship
  • Agency relationship
  • Fiduciary relationship
  • Joint venture

between the user and Gamira.

Important Emergency Notice

Gamira is designed to support independent aging, family communication, care coordination, and everyday wellness.

Gamira is not a substitute for a doctor, nurse, hospital, ambulance, emergency service, or other qualified professional.

In an emergency or life-threatening situation, contact the appropriate local emergency service directly.

Using Gamira means you agree to these Terms.
